This Warranty is applicable to installations occurring after March 1, 2019

What Does This Warranty Cover?

Rettig USA, Inc. d.b.a. Myson (“Rettig”) warrants that the products (Product or Products) listed below shall be free from defects in material and workmanship, manifested under normal conditions of use.

How Long Does the Warranty Coverage Last?

This limited warranty shall commence on the date the Product in question was sold by Rettig (“Sale Date”) and shall expire in the following number of years;

Radiators
T6 Series, CV/RCV/Contractor Series, Column Series, Select Series, Décor Series - all ten (10) years

Fan Convectors
All hydronic kickspace (K), wall mount units (WM), recessed commercial units (RCU) and iVector (MKII & S2 Units);

Heat exchangers: Ten (10) years
Fan assemblies: Three (3) years
Other components: One (1) year

All electric kickspace (WE50K): Three (3) years

Towel Warmers
European Tradition Collection, Contemporary Designer Collection, Classic Comfort Collection – all ten (10) years
Gem Collection – all two (2) years
Valves, Controls & Accessory Items – all two (2) years

What general conditions and limitations are applicable to this Limited Warranty?

All of the warrants listed above are subject to the following:

This Limited Warranty applies only to Products sold by Rettig. For this Limited Warranty to apply; (1) receiving, handling, installation, use and maintenance must continuously comply with any and all written documentation as provided by Rettig whether electronically, contained within or on Product packaging or on the Rettig website, currently www.MysonComfort.com.; (2) Product must be carried out in accordance with applicable local, state/province or national building, electrical, mechanical building code and following accepted industry guidelines; (3) Product must not be damaged either in transit, installation or after installation from improperly designed or maintained systems or from improper use or from misuse, neglect or accidental damage; (4) Product must be installed by an appropriately trained and licensed installer; (5) Product must not be exposed to harmful chemicals, corrosive environments including corrosive or improperly maintain heating system water, improperly designed or maintained hydronic systems or electrical systems; (6) Product must not be subject to unauthorized alteration, changes or repairs; (7) Product must be installed for the intended use.

RETTIG FURTHER DISCLAIMS ANY RESPONSIBILITY FOR LOSSES, EXPENSES, INCONVENIENCES, AND SPECIAL, INDIRECT, SECONDARY, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OR RESULTING IN ANY MANNER FROM THE PRODUCTS COVERED HEREUNDER.

SOME STATES OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

This Limited Warranty is applies to the United States and all Canadian Provinces except Quebec.

This Limited Warranty may not be assigned and is applicable only to the owner of the real property where it is originally installed and is provided in lieu of all other warranties whether expressed or implied on the part of Rettig. Rettig disclaims any warranty expressed or implied. This Limited Warranty is the extent of express warranties by Rettig.

How Do You Make a Claim under this Limited Warranty?

To make a claim, your written notification of the claimed failure must be received by Rettig at the address below within the applicable warranty period and within thirty (30) days of the believed failure or breach and while the damaged portion is still available for inspection. All products claimed to be defective must be made available to Rettig for testing and determination of cause. Upon receipt of a warranty claim, Rettig shall have ninety (90) business days in which to determine whether it acknowledges responsibility for any asserted defects in material or workmanship and the appropriate course of action to be taken.

If Rettig determines that a Product is defective, it will be at Rettig’s option to repair or replace the defective product or providing a refund of the defective Product’s purchase price. Rettig will not be liable for any costs for labor or supervision for removal or reinstallation or transportation or any other charges which may arise in connection with a warranty claim.

Warranty Claim Dispute Process:

In the event claimant and Rettig USA, Inc. are unable to resolve a claim through informal means, the parties shall submit the dispute to the American Arbitration Association, phone number: 800-778-7879, or its successor (the “Association”) for arbitration, and any arbitration proceedings shall be conducted before a single arbitrator in Williston, Vermont.

You may be able to sue in State Court, in the state of Vermont without using the Arbitration provision above. However, you may not sue Rettig USA, Inc. under the Magnuson-Moss Act unless you first use the Arbitration provision contained herein.

NOTWITHSTANDING THE FOREGOING, NEITHER THE CLAIMANT NOR RETTIG. SHALL BE ENTITLED TO ARBITRATE ANY CLAIMS AS A REPRESENTATIVE OR MEMBER OF A CLASS, AND NEITHER THE CLAIMANT NOR RETTIG SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS WITH ANY OTHER PARTIES IN ARBITRATION OR IN LITIGATION BY CLASS ACTION OR OTHERWISE.

DISCLAIMER OF IMPLIED WARRANTIES.

THIS LIMITED WARRANTY IS THE FULL EXTENT OF EXPRESS WARRANTIES PROVIDED BY RETTIG USA, INC., AND RETTIG USA, INC. HEREBY DISCLAIMS ANY WARRANTY NOT EXPRESSLY PROVIDED HEREIN, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRODUCTS COVERED HEREUNDER. RETTIG USA, INC. FURTHER DISCLAIMS ANY STATUTORY OR IMPLIED WARRANTY OF HABITABILITY.

THIS LIMITED WARRANTY GIVES THE CLAIMANT SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

Venue Location of Any Suit

All parties to this warranty agree that this limited warranty and any claims arising from breach of contract, breach of warranty, or any other claim arising hereunder, shall be governed and construed under the laws of the State of Vermont. It is also understood and agreed that authorized Rettig, Sales Representatives, and Distributors have no express or implied authority to bind Rettig to any agreement or warranty of any kind without the express written consent of Rettig.
